Essay

The dissertation provides a comprehensive and systematic study of the administrative-legal regulation of the production and circulation of children's food. It is defined that the sphere of nutrition as an object of legal research is: 1) multi-faceted. Its content, specificity, and directions of development should be considered in the aspect of ensuring the nation's health factor and the type of public administration; component of the economy; element of industrial security of the state, which is a species element of national security; marketing activity; 2) the state policy in the field of nutrition is of a non-systematic nature, which is expressed in the absence of measures to stimulate operators-producers in the field of nutrition, and, on the contrary, in the application of strict administrative measures by the state; 3) it is necessary to ensure a continuous chain process in the field of nutrition - "state-operator-food producer-buyer"; 4) there is a competitive dynamic in the development of the nutrition sphere, and children's nutrition in particular, which is determined by socio-demographic, economic factors, and purchasing power of buyers; 5) it is necessary to introduce measures of state support aimed at modernizing the production facilities of enterprises in the nutrition sector, for example, within the framework of public-private partnership; 6) the wear and tear of production facilities and high administrative pressure on business entities in the field of nutrition negatively affect the quality and safety of food products and the development of the nutrition sector as a whole; 7) it is necessary to ensure conditions for dialogue between the business in the field of nutrition and the state in the person of authorized competent entities. It is noted that the mechanism of administrative-legal regulation of the production and circulation of children's food is a system of interconnected elements that exert legal influence on the behavior of subjects through special legal means in order to ensure infants and young children with sufficient, high-quality, and safe children's food and their constitutional right to life and health protection. The necessity of establishing a body within the structure of the State Service of Ukraine for Food Safety and Consumer Protection is argued, namely the Commission on the Development of Children's Nutrition. It is noted that the form of administrative-legal regulation in the field of production and circulation of children's food is a legal instrument used by authorized subjects of public administration in the field of ensuring infants and young children with adequate, high-quality, and safe children's nutrition with the aim of realizing the constitutional right of the child to life and health protection. It is proposed that the method of administrative-legal regulation in the field of production and circulation of children's food be understood as the totality of various methods, techniques, and means of exerting direct and purposeful influence by public administration bodies and their officials within their competence on administrative-legal relations arising in the process of production and circulation of children's food with the aim of guaranteeing the constitutional right of the child to life and health protection, ensuring children with safe and quality nutrition, and implementing state policy in the field of production and circulation of children's food. Studying international experience in the production and circulation of children's food recommends: 1. Implementing a three-tier quality and safety control system for children's food: the first level - control and supervision by a specially authorized executive authority acting under the government of the country (e.g., commissions); the second level - the level of local authorities (departments (departments) in certain territorial units); the third level - internal control at the facilities of the children's food producer; 2. Practical implementation of the HACCP system, which allows improving the quality and safety of children's food, making them economically attractive and competitive in the global children's food market; 3. Determine further prospects for the development of the raw material base of the dairy industry and trade in dairy processing enterprises with EU countries; 4. Pay special attention to labeling and informing the buyer about the quality characteristics of children's food; 5. Introduce digitalization processes in the production and circulation of children's food; 6. Introduce an electronic system - the "Children's Food Safety" module.
