Essay

The dissertation is dedicated to consideration of problems of one of the most complex, theoretically and practically important institutions of Criminal Law of Ukraine - complicity in crime. Its novelty is in the investigation of the following things on the basis of the practice of the Autonomous Republic of Crimea (ARS): controversial issues of the concept of complicity (an extended and verified definition of this concept as committing an intentional crime by joint deliberate actions of two or more persons); the history of its development in the theory and legislation of Ukraine and former Soviet Union; the classification of the forms of complicity; objective (quantitative) and subjective features of complicity; kinds of accomplices and significance of their classification for qualification of crimes; the basis and limits of responsibility of accomplices taking into consideration different degrees of social danger of each of the accomplices and their actions; complicity, organized crime as special kind of group crime; corruption. The main results of the investigations have been formulated in the conclusions, containing new theoretical statements, mainly definite proposals to the new Criminal Code of Ukraine as specifically formulated articles of "General and Special parts on responsibility for complicity in crime".
