Essay

The dissertation investigates for the first time the notion and content of the legal status of civil servants as subject to labour law as equal rights participants of labour legal relations, as well as the specifics of regulating relations by labour and specific legislation. The thesis provides historical and comparative analysis of evolution of the legal status of this category of employees. It defines the components of civil service as a type of labour activity involving performance of socially required functions. It also indicates the special traits of this position which can be used as subjective criteria for defining employees with this status. This status can be formulated as a set of rights and duties, additional guarantees and the high level of responsibilities, which is caused by their role in the state structure of society and as those that are stipulated by labour agreement. The civil service agreement is defined as a form of Labour agreement. Based on the theoretical conclusions and analysi s of current legislation, there are developed and introduced proposals regarding the improvement of legal procedure dealing with regulation of civil service by employees and securing their subjective rights and duties.
