Essay

The dissertation determines legal grounds for formation and development of nuclear law as a complex legal branch in the system of Ukrainian law. The dissertation examines the subject, methods, system and main institutes of nuclear law, as well as the role of nuclear legislation in the formation and development of nuclear law. It also demonstrates the peculiarities and importance of nuclear law in the process of securing legal regulation of the activities in the sphere where nuclear energy is used, in particular, in nuclear and radiation safety, for the purposes of protecting the life and health of people and protecting the environment from radioactive pollution.The terms "nuclear" and "radiation" (radioecological) safety are being defined in the dissertation as a prerequisite and a component of environmental safety. The dissertation analyses the place of the institutes of nuclear and radiation (radioecological) safety in the system of national security and their correlation with environmental safety . It also determines the primary legal means for securing safe use of nuclear energy and securing nuclear and radiation safety.The dissertation provides proposals for improvement of the current Ukrainian legislation, including by adoption of new laws, and proves the need for a new Ukrainian law "On compensation of nuclear damage and nuclear insurance", a draft of which is proposed. The main results of the work have been implemented in improving current and drafting new legislation, as well as in teaching special courses on "Nuclear Law in Ukraine", "Nuclear legislation in Ukraine" and "Civil liability for nuclear damage"
