Razvadovskiy V. State regulation of the transport system of Ukraine (administrative and legal problems and the ways of their solving).

The problem of defying the essence of the state regulation of the transport system of Ukraine is investigated. The content of the notions of "state management", "state regulation" is formulated and their relation to the notion of "administrative and legal regulation" is determined. Elements of the transport system of Ukraine and the problems of their regulation by the state are determined. Principles and functions of the state regulation of the transport system are formulated. Subjects of the state regulation of the transport system, trends and forms of their activities, and administrative and legal means of providing safety of road traffic are determined. Expediency of determination of the transport legislation as a complex formation within the system of law is grounded. It is neither a kind of law nor a part of it. Within the system of transport legislation one should single out the legislation which includes norms of the administrative law. Legal relations in the sphere of activities of transportand their administrative and law regulation are analyzed. The ways of improving the state regulation of the transport system: organizational (taking into account the world experience) and legal (a draft of the Law of Ukraine "On roads" and a structure of the Road code of Ukraine) are determined.
