Ileyko V. Posthumous forensic-psychiatric expertise in civil trial (questions of the theory and practice).

On the basis of study of theoretical aspects of posthumous forensic-psychiatric expert research the contents and definition of key concepts of the domestic legislation is proved which are connected to mental condition of the person, the offers on change of conforming clauses of the civil legislation are brought in. At analysis of the data reflecting conducting posthumous FPE the disadvantages are revealed which are connected to its appointment and performance, in particular, imperfection of the existing methodical approaches concerning frame of the examination claim, assessment of objects of expert research, formulation and substantiation of expert conclusions. Is developed, tested at conducting posthumous and life FPE and it is offered: а) a new method of research - expert method; б) of procedure of an assessment of objects of examination and taking formal note posthumous FPE in civil trial, that will allow to provide scientific character and aprovement of expert conclusions.
