Essay

Thesis is devoted to the analysis and solving of theoretical and practical problems of official and labor relations contents in Ukraine. Peculiarities of state service origin and development in Ukraine are analyzed. The notion, place, role and kinds of state service are viewed; modern state of normative and legal guarantee of state service is analyzed; characteristic of organizational and legal guaranteeing of official and labor legal relations in the sphere of state service of Ukraine is given in this thesis. An importance of new understanding of the structure of official and labor legal relations is stated; legal status of state employee as an subject of official and labor legal relations is analyzed; classification of state employees as the participants of labor legal relations is given. Special attention is paid to the definition of special features of state employees of Ukraine job legal regulation, to the research of official and labor relations’ legal regulation differentiation, to solution of the problems of origin, development and stoppage of official and labor relations in the sphere of state service. Modern foreign experience of official and labor legal relations organization is researched; possible ways of its usage in Ukraine are defined; characteristic of law guarantees as a factor of state employees’ official and labor activity stability and effectiveness improvement is carried out; recommendations about social and legal protection of state employees are elaborated. Social and legal mechanism of state employees’ legal responsibility formation is learned. Propositions about concrete changes and additions to the legislation in force introduction as to stated problems are formulated."
