Yaroshenko O. Sources of the Labour Law of Ukraine

The thesis is devoted with the actual theoretical and practical problems of the sources of the Labour Law of Ukraine. The idea modern system of the sources of the Labour Law of Ukraine, the featutes of particular elements are studied. Their interconnections and interdependences are defined. The necessary of the separate codification of the material and procedure law rules about the labour through the process of adoption the labour and labour procedure Code is proved. Important attention is devoted to the conception, significance, role and function of acts of social partnership and local regulations as well as their place in the system of the sources of Labour law in modern society. The legal nature of acts of the Constitutional Court of Ukraine, the decisions of the European Court of Justice for Human rights and customs are determined. The issues are decided about their opportunity relating to the sources of Labour Law. Maintenance of oneness and differentiation of legal regulation of labour in modernsociety are emanined. Legal nature and kinds of hiatuses and collision in Labour Law are analyzed, the causes of their emerging and methods of their overcome are considered. Concrete proposals about improving the Labour Law of Ukraine were formulated on the base of putting through the investigate.
