Gurdji J. Legal protection of a person in the criminal procedure of Ukraine: theory and methodology.

In the thesis there are considered problematic theoretical-legal and methodological issues of the mechanism of provision of the rights and legal interests of a personality in the field of criminal law enforcement of Ukraine. Individually there are analyzed approaches, spread in modern theoretical-legal scientific literature, to study of guaranties of rights of a person in the theory of law and in the criminal procedure law. On the ground of the analysis of modern views regarding theoretic-legal problems of legal means in theory of law and legal practice there is determined an author's vision of a number of methodologic issues, associated with the perspective of investigation of legal means of legal procedure defence of the rights and legal interests of a person in modern Ukraine. A special methodological role of the theory of a legal procedure in scientific researches, that were oriented at formation in Ukraine of conditions of legal protection of citizens in the field of criminal law enforcement, is emphasized. A particular role in the issue of methodological renovation and securing of a criminal procedure investigation of law enforcement problems is assigned to the leading methodological approaches, used in modern science of law. It goes about instrumental, axiologic, anthropologic methodological approaches. A special role is assigned to problems of law conception in formation of world outlook component of a cognitive horizon of a branch researcher."
