The theoretical basis of the government in Ukraine . Thesis for a Doctorate in Law with the speciality 12.00.02 – constitutional law; municipal law. - Legislation Institute of the Verkhovna Rada of Ukraine. - Kyiv, 2009. The dissertation is devoted to new problem not investigated in complex earlier – to becoming the organization and functioning of the government in Ukraine, after finding of independence by Ukraine, in which on the basis of works of philosophers both lawyers are investigated the maintenance and properties of authority as patrimonial category, and on this basis the basic properties of the government as separate kind of the given category on the basis of what it is formulated concepts of the government of Ukraine are defined. The basic stages of becoming of the government on the basis of corresponding legal certificates, projects of the Constitution, results of carrying out of the constitutional reform are investigated. During illumination of a question on the organization of the government the problem of the account of its organization of mutual relation of a principle of democracy with the government, constitutional – legal bases of the statement of last as necessary basis of its organizations, a role of system stop and counterbalances as important is considered. Be consideration of a problem about functioning of last the questions connected with realization of legislature by parliament of Ukraine of a role of executive authority during functioning of the government, realization of judicial authority and feature of a legal status of the President of Ukraine, its place and a role during functioning the government in Ukraine are investigated.
