Boyko A. Theory of Determining Economic Crime in Ukraine under Conditions of Transition to Market Economy.

Based on the research of social processes, relationships and other connections in the society the essence and the peculiarities of the determination of economic crime, the regularity and the mechanism of formation and realization of the structure of the determination are defined in the dissertation. The main concepts of foreign and national criminology as to the core and forms of the economic crime are discovered. The methodological grounds of the economic crime cognition are suggested. The nature of the social phenomenon of "economic crime" has been established. The modern definition of the economic crime concept is offered. The philosophic-methodological grounds of crime determination understanding, including the general concept of determination, peculiarities of social determination and its manifestation in the determination of crime are revealed. The essence, the main regularity and features of transformation of command-administrative national economy into market one are researched. The condition of transformation of Ukrainian economy of market type is analyzed and criminological estimation of the negative results of its reforming is made. The peculiarities of determination of economic crime in Ukraine under conditions of transition to market economy are researched and according to that the theoretical grounds of the examination of that social process and conditional determining complex are defined. It is defined and theoretically analyzed the major components of the structure of the determination of economic crime in Ukraine under conditions of the transition to market economy. On the grounds of research of economic crime determination under conditions of transition to market economy the theoretical grounds of use of these results for improving of the prevention system and counteraction to the mentioned type of crimes have been defined.
