Andriiv V. System of labour rights of employees and mechanism of their enforcement.

The thesis is devoted to research of the system of labour rights of employees and legal mechanism of enforcement, disclosure of nature and pecularities of constituents of the abovementioned mechanism, development of specific propositions and recommendations on it's improvement, aimed at more comprehensive establishment and provision of human rights in the sphere of waged labor. Nature of labour rights of a person and citizen, their place in the system of labour rights is defined. Evolution of labour rights and basic tendencies of their development in the beginning of the XXI century is investigated. Labour rights are classified according to different criteria. Modern state of legal regulation of basic labour rights of employees in current legislation and the Draft Labour Code is analyzed. Comparative-legal analysis of legal regulation of individual and collective labour rights in international acts and acts of national legislation is performed. Nature and pecularities of mechanism of realization of labour rights are defined. Constituents and content of the mechanism of protection of labour rights of employees is researched. Mechanism of defense of of labour rights and legal interensts of employees is studied. Forms and measures of defense of labour rights of employees are characterized and propositions on their legislative fixation are introduced. Specific propositions and recommendations on improvement of current labour legislation and Draft Labour Code in the sphere of enforcement of labour rights and legal interests of employees are formulated.
