Ryabchynska O. Theoretical and legal principles for the functioning of the penal system in Ukraine.

The thesis is dedicated to the analysis of theoretical and legal principles for the functioning of penal system in Ukraine. Based on well balanced gnoseological, ontological and methodological approaches the definition of "penal system" term was given. The situation with realization of penal system features in criminal law and law enforcement is figured out and whereby a conclusion about the level of its functionality was made. The place of the penal system among other criminal remedies was indicated. The influence of criminal policy principles, legal regulation and criminal law on penal system formation was defined and disclosed as well as actual situation of accordance between them and penal system was explored.
