Essay

Dissertation is devoted to problems of formation and development of information law in Ukraine. Stages of evolution of information legislation in Ukraine are named, genesis of the concepts of "information environment", "information law", "information activity", "information and legal norm", "information procedure" is revealed and the author's definitions of these legal categories are suggested. Considerable attention is paid to clarification of the system, functions and principles of information law. Their content and classification are defined. The arguments are given, revealing the fact that the most effective in theoretical terms for Ukrainian system of legal provision of functioning of the national information society is the adoption of Information Code of Ukraine. In this regard, conceptual approaches to the development of legislation in the information field are outlined, specific suggestions for its improvement are shown. Draft Concept of the information law and information legislation of Ukraine is proposed, which develops the ideas, expressed by scientists earlier. System, tasks, functions and powers of the subjects of information law are specified, together with directions of their interaction and ways of improvement of the effectiveness of information legislation and its practice of its application. Provisions regarding implementation of international standards of information society in the national model are proved. The comparative analysis of legal regulation of information relations in Ukraine and in other countries is made, on the basis of which proposals are made regarding the possibility of using of foreign experience in the law-making activity of the Ukrainian state.
