Essay

The thesis is devoted to the development of conceptual model for good-quality standards of criminal procedural decisions and studying the problem of compliance with these standards in practice. The essence of 'criminal procedural decisions standards' concept had been found out and their functionality had been defined. The essence of legality, reasonableness, motivation, fairness, rationality and timeliness as legal standards of procedural decisions good-quality had been revealed, the criteria and indicators through which they are specified had been set out. A theoretical and applied model for monitoring the quality of procedural decisions had been proposed. The notion of 'enforcement of standards for criminal procedural decisions good-quality' has been stated, in the context of ensuring practical feasibility of the developed concept standards, the subjects, time span, main rules and elements of efficient activities have been outlined. A range of proposals aimed at improving the current criminal procedural legislation to ensure high quality of procedural decisions adopted in the course of criminal proceedings have been presented.
