Essay

The thesis deals with the comprehensive analysis of judicial cognition through conceptual philosophical and legal understanding of its value-epistemological, existential-semantic, logical-technical, experiential-implicational constant levels. Judicial cognition is defined in the value-deontological trend as manifestation of philosophical, spiritual, moral orientation of a judge; in the identifiable-ascertainable trend - as a measure of providing effective synergy of statutory priorities of judicial activities; in the perspective-oriented trend - as a factor of establishing the maxims of free democratic justice. Judicial cognition is not determined only by the mechanical finding of facts, it is as a phronetic experience that, on the one hand, covers the knowledge, ability, skills, and on the other hand, it is discursively intersubjective, aimed at mutual communication among the participants of the court session.
