Kushnir S. Государственный контроль в сфере высшего образования в Украине: организационно-правовой аспект

The thesis presents a theoretical generalization and a new solution to a scientific problem – the essence, characteristic features, and organizational and legal aspects of state control in the field of higher education in Ukraine are revealed. A review of state control as an integral category is conducted. The author stresses that this category covers various spheres of social existence, permeates actually all levels of social relations, has signs of an epistemological object, an object of knowledge on the part of various sciences of the social and humanitarian cycle. It is proved that the multiplicity of control as a phenomenon determines the existence of a variety of approaches to the definition of the essence of control not only in legal literature but also in philosophical, sociological, political science literature, various sources of the doctrine of public administration, etc. On the basis of the analysis of the historiography of the study of state control principles, the definition of the etymology of the word “control”, the consideration of legislative definitions of “control” and “state control”, the ratio of control to other legal categories and concepts, and a general review of state control classifications, the following features of state control are outlined: state control is a component of social control and an integral part of state activity, a manifestation of its function; is characterized by a special subject of implementation – dedicated government agencies (officials); has a permanent basis and state-owned nature; provides for the operational intervention of authorized state authorities in the activities of objects and the possibility of coercive measures in case of detecting violations of the law.
