Ochkurenko S. The Place of Financial Law in the System of Law of Ukraine

The thesis describes the results of research of the place of financial law in the system of law of Ukraine and inter-branch relations of financial law. It is stated that the development of the system of law, identification of branches of law, updating of subject of each branch of law is carried out according to the goals and objectives of branches of law that are revealed by legal science and social practice taking into account public relations dynamics and their further development requirements. There have been substantial changes in public relations system after gaining state independence of Ukraine. Awareness of new goals and objectives caused expansion of the subject of financial law. Public relations regarding ensuring efficient money flow with participation of banks, professional participants of stock market and insurers are also referred to the subject of financial law in addition to the relations in formation, distribution and use of centralized and decentralized monetary funds. This logical expansion of the subject of financial law complicated the problem of differentiation of financial law and other law branches. Unjustified attempts have been made to expand the subject of financial law at the expense of civil relations regarding providing financial services. But financial law regulates only public relations in this sphere.
