Essay

The dissertation is dedicated to a comprehensive disclosure of the legal nature and essential properties of legal regimes in the labour law of Ukraine in their systemic functioning. Based on the analysis of methodological approaches to the understanding of the category of the «legal regime» and its definitions and properties enunciated within the theory of law, branches of law, a generalized approach to its understanding and essence has been developed, which made it possible to disclose the concept of labour-law regime objectively and subjectively and distinguish its characteristic features, conditioned by the nature, tasks and functions of labour law as a branch. It was proven that all types of regimes belong to the sphere of labour-law regime, which is general for employment relations, primary, and generic with regard to all types of regimes in the field of labour law. The work describes the legal means which sort of serve as factors that define and aim the functioning of the labour-law regime and determine its specifics. For an efficient and meaningful legal regulation of social relations in the field of hired labour it is suggested to use a typical model of labour-law regime, the essence of which would combine the social interest – on the part of the employee, and the production interest – on the part of the employer.
