Zlyvko S. Administrative and legal ensuring of the activity of the heads of penal bodies and institutions in Ukraine

The thesis is the first complex monographic research of administrative and legal ensuring of the activity of the heads of penal bodies and institutions in domestic legal science. The current state and main problems of the Penitentiary Service functioning due to the influence of a new place of this service in the system of public administration in the field of Justice are examined; the main peculiarities of forming the principles of administrative activity on the basis of conceptual acts on reforming Penitentiary System of Ukraine are revealed; the system of basic principles of administration in the field of execution of punishments and their using in the heads’ activity is formed; the peculiarities of the activity of the heads of different law enforcement bodies are determined; a head as an element of the system of subjects of administrative and legal relations in the field of execution of punishments is described; legal regulation of head’s activity in the system of execution of punishments is analyzed; the main international standards are systematized as the basis of a penitentiary manager’s activity; the key aspects of applying the administrative procedures of selection and appointment the heads of Penitentiary System are revealed; the key components of professional competence of a head of a penitentiary institution are formed; managerial role of a head in conditions of domestic Penitentiary System transforming is determined; basic principles of information and legal support of ahead’s activity in the system of execution of punishments are analyzed; managerial risks of a head’s activity in the system of execution of punishments are determined. For the first time, administrative and legal ensuring of the activity of the heads of penal bodies and institutions is considered to be a part of the concept of administrative and legal support and administrative activity of the State Criminal and Executive Service of Ukraine and is defined as a system of notions about legal status, forms, methods and principles of activity, the issues of forming and qualitative organizational support of the heads’ of mentioned service functioning.
