Lesko N. Administrative and legal provision of formulation and realization of the state policy in the area of children’s protection from violence and other wrongful acts

Dissertation is devoted to the analysis of the administrative and legal provision of formulation and realization of the state policy in the area of children’s protection from violence and other wrongful acts as strategy of action of government and society in general in regard to children’s protection from any violent acts, violating the right of a person to the integrity of the person guaranteed by the Constitution of Ukraine. Definition of the state policy concerning children’s protection from violence and other wrongful acts was formulated. Legal regulation of children’s protection from violence in the family, legal basis for children’s protection from human trafficking, legal principles of children’s protection in an educational environment, children’s protection from violence during warfare and military conflicts were considered. Legal status of the subjects of formulation and realization of the state policy in the area of children’s protection from violence and other wrongful acts was analysed. Administrative and legal basis for the prevention of violence and other wrongful acts concerning children caused by globalization processes and the development of informational society were characterized. It is offered to introduce criminal responsibility for placing and spreading in the Internet of the information containing child pornography, scenes of violence, commercial exploitation of children as well as facts of grooming, cyberbullying of a child, as a result of which harm to the physical or psychological health of a child could have taken or took place. The position of the creation of the Department for the prevention of violence and other wrongful acts concerning children at the Ministry of Social Policy of Ukraine is maintained in the dissertation. The need in the implementation of state statistical reporting of the events of domestic violence and gender-specific violence as reporting form, that is approved by the specially authorized body in the sphere of prevention and response to domestic violence on quantitative and qualitative characteristics of the events of domestic and gender-specific violence is substantiated. Proposal on making changes and amendments to the current legislation of Ukraine in the part, related to state policy in the area of children’s protection from violence and other wrongful acts.
