Sybiha O. Administrative-legal provision and judicial protection of the human right to access to public information

The dissertation is devoted to comprehensive research of administrative-legal provision and judicial protection of the human right to access to public information. Based on the analysis of scientific sources and national legislation the author presents his own definition of the concepts “administrative-legal provision of the human right to access to public information” and “judicial protection of the human right to access to public information”. In particular, administrative-legal provision is defined as the system of legal measures connected with the consolidation of the legal status of subject of relations in the sphere of access to public information, which are regulated by substantive and procedural rules of administrative law, and with determination of the order of obtaining and providing such kind of information. Judicial protection is defined as the procedure, which is stipulated by the norms of administrative procedural law, for reviewing a dispute arising between a person and public information administrator regarding the appeal of his decisions, actions or inactivity in the context of access to public information with the purpose of effective protection of the rights, freedoms and interests of individuals as well as the rights and interests of legal entities from breaches of public information administrator.
