Karelin V. Administrative and legal regimes in the field of organization of punishment execution

The dissertation is focused to in-depth analysis from the point of national and international experience of the general theoretical aspects of establishing and implementing the administrative and legal regimes in the field of organization of punishment execution and is the first comprehensive scientific research of the problem in national science of administrative law. The scientific novelty of the dissertation is due to the comprehensive definition of the nature and essence of administrative-legal regimes through the development of conceptual principles of the administrative and legal regimes implementation in the field of the organization of punishment execution; disclosure of peculiarities and significance of departmental control to ensure law and order in penitentiary bodies and establishments; systematization of appropriate measures of administrative influence; analysis of the role and place of the administrative and legal regimes in the regulation of the investigated legal relations arising in the criminal-executive activity of the relevant society institutions, etc. A measure such as "administrative supervision of persons released from serving sentences" is proposed in the structure of state coercion, to be attributed to the structure of "administrative coercion" as a measure aimed at warning or preventing of committing offenses. It is proved that personal, social, professional and other rights of employees of penitentiary bodies and establishments will be ensured through a comprehensive implementation of a number of different nature measures in practice. On the basis of the analysis of doctrinal views in science of administrative law regarding the concept of administrative proceedings, its characteristic features and elements, the definition of administrative-regime proceedings in the field of punishment execution is proposed. The classification of administrative-regime proceedings is carried out depending on the process types, etc.
