Essay

The dissertation is dedicated to the development of a model of forensic psychiatric assessment of the ability of persons with dependence on psychoactive substances to realize their actions and (or) to manage them in order to prevent repeated criminal actions. The research was based on analyzing materials of the mental state study of 661 persons with dependence on psychoactive substances and its influence on the ability to realize of their actions and (or) to manage them. Of these, 206 case reports were forensic psychiatric examinations in civil proceedings and 455 cases in criminal proceedings. In the results of a comprehensive analysis of current trends in the expert evaluation of state of dependence has been highlighted the professional, ideological, methodological and real-practical reasons for narrowing expert decisions in the current legislation. It had received current data on the structure and features of the offenses depending on the type of substance abuse were obtained, including: combatants. Clinical-situational determinants of their aggressive behavior have been established. Clinical and social characteristics were revealed and described, which substantially supplement the idea of the directions and targets of their psychosocial rehabilitation. For the first time from forensic psychiatry expert view was studied the impact of mental and behavioral disorders in persons with syndrome of psychoactive substance abuse on their ability of fully realize and / or manage their actions, taking into account changes made in recent years in legislate. It is established that the criteria of limited responsibility of persons with abuse are personal (emotional-volitional) and / or cognitive disorders of moderate or expressed degree, which participate in the genesis of illegal acts, thereby significantly affecting the volitional and / or intellectual component of the ability to realize of their actions and manage them. For the first time was developed an integrative model of forensic psychiatric expert evaluation of mental disorders in persons with addiction to psychoactive substances, which defines the goals of expert research, algorithm for evaluation of medical and legal criteria, their integrative components. According to the syndromic structure of the medical criterion, model substantiates the expert decision, in which are based the criteria of choice of medical-legal measures and gives evidence to expert opinions. It allows to differentiated choice of medical-legal measures with the aim of ensuring justice, to respected of rights and freedoms of persons with mental disorders and to prevented repeated criminal actions.
