The thesis generalizes the theoretical generalization and new solution of the theoretical and legal provisions and practical problems of optimization, procedural economy of repressive influence in criminal proceedings by the prosecution against the participants of the process. Theoretical elements of applying an individual approach to a person are proposed if he or she is a member of the criminal proceedings of a suspect, accused on the basis of fairness. The content and functions of the prosecution party in case of a procedural decision on conducting a pre-trial investigation are disclosed. Provision has been made to close criminal proceedings against a person unless the party has been informed of the charge by the prosecution at the pre-trial stages. The legal constructs of closing criminal proceedings and saving them at court stages are defined. The methodology for optimizing pre-trial proceedings is outlined and the concept of a methodological approach based on general, special, sectoral and cross-sectoral methods is proposed. The optimization of the legal process on the basis of competitiveness and publicity is offered.
