Melnyk V. Social protection of persons with disabilities: theoretical and legal problems.

The dissertation deals with the theoretical and legal problems of social protection of persons with disabilities. The concept of social protection of persons with disabilities is considered, its peculiarities are revealed and its principles are described. The emergence and evolution of social protection of persons with disabilities on the territory of Ukrainian lands in the pre-Soviet era (before 1917), the formation and development of legal regulation of social protection of persons with disabilities on the territory of Ukrainian lands in the Soviet era (1917–1991), the emergence and formation of the latest legislation on social protection of persons with disabilities in the conditions of independence of Ukraine. The concept, features and content of the social and legal status of persons with disabilities are investigated. The basic international social standards on the rights of persons with disabilities are considered, the features of the legal regulation of social protection of persons with disabilities in the EU, the legal regulation of social protection of persons with disabilities in individual EU Member States and the CIS are revealed. The theoretical and legal problems of organizational and legal forms of social protection of persons with disabilities are revealed. Disability pensions are considered as a separate type of social protection of persons with disabilities, social assistance in the system of types of social protection of persons with disabilities, rehabilitation of persons with disabilities in the system of social protection. The tendencies of legislative support of social protection of persons with disabilities are defined, namely: ways of adaptation of legislation on social protection of persons with disabilities of Ukraine to international (European) social standards, problems of codification of legislation on the rights of persons with disabilities.
