Essay

The principle of citizens equality before the law has been characterized in accordance with theoretical and legal standpoints. The genesis and evolution of the content of the equality principle in different epochs and in different societies have been studied. Specific features of the equality idea’s formation and the principle of equality before the law in the national political and legal thought and law have been separately studied. The essence of the constitutional principle of citizens’ equality before the law has been clarified. Particular attention has been paid to the study of the categories of “equality”, “law”, “citizen”. The author has outlined a number of negative factors that hinder the full implementation of the constitutional principle of citizens’ equality before the law in Ukraine. The constitutional and legal grounds of the principle of citizens’ equality before the law have been elaborated. Based on the analysis of Ukrainian legislation the author has expressed the idea that the principle of citizens’ equality before the law has the form of differentiated equality, which, in cases provided by the law, allows the existence of positive discrimination. International standards of recognition and normative consolidation of the principle of citizens’ equality before the law have been clarified.
