Deineha M. The Subject and the System of Natural Resources Law

The thesis has been devoted to the comprehensive analysis of theoretical and practical issues of formation and development of the subject and the system of Natural Resources Law. The conceptual fundamentals of Natural Resources Law formation and development have been researched. The scientific concepts and principles of relations between human and nature as the basis for formation of the subject of Natural Resources Law has been discussed, scientific thought development for determining the subject of Natural Resources Law has been analyzed, and its features in the context of general theoretical provisions on the law branch subject have been highlighted. The problematic issues of Natural Resources Law, Nature Protection Law and Ecological Law delimitation have been outlined, the hierarchy of Natural Resources Law and post-resources branches of law, the ratio of their subjects legal regulation have been determined, the specifics of Natural Resources Law and Civil Law interdisciplinary relations have been analyzed. The theoretical bases of the system of Natural Resources Law and features of the legal content of separate structural elements of the system of Natural Resources Law have been investigated. The basic tendencies of development of theoretical ideas about the subject and the system of Natural Resources Law have been defined, the features of formation of the subject and the system of international Natural Resources Law in the context of development of international Environmental Law have been outlined, the state of approximation of natural resources legislation and law of Ukraine on the concept formation of development of natural resources legislation system of Ukraine. On the basis of the conducted research the offers on legislation improvement in the field of legal maintenance of natural resources use and reproduction have been developed; the theoretical conclusions that can be the basis for further development of the Natural Resources Law science have been suggested.
