Essay

The dissertation is devoted to researching the theoretical and methodological bases of administrative and legal fire safety provision in the forests of Ukraine at the current stage. In the research the conceptual and categorical apparatus in the field of administrative and legal support of fire safety in forests has been clarified. Administrative and legal support of fire safety in forests is outlined as a component of a separate institution of a specific part of administrative law, considering it within the hierarchical composition, which justifies the interdependence of its individual levels. Organizational principles of fire safety in the forests of Ukraine have been studied through a comprehensive system of interrelated practical measures, which are presented in the form of two groups: preventive safety measures and actual safety measures. An analysis of scientific approaches to the feasibility of «integrated fire management in natural ecosystems» implemented in the United States and a number of other countries allows us to identify several promising areas of «forest fire management». I’m the research a set of main problem aspects in the context of ensuring the effectiveness of fire safety in forests is identified. The own vision of complex, multilevel character of system of administrative and legal maintenance of fire safety in woods is formed. Emphasis is placed on the fact that the lack of approved strategic documents for the development of the forest sector makes it impossible to form the projected state policy, and thus creates unregulated organizational and legal management structure in the field of forest relations in general and reduces the effectiveness of fire safety in forests in particular. Further, the development and adoption of a number of regulations in order to improve the administrative and legal regulation of fire safety in forests is proposed. The problematic aspects, inconsistencies and legal conflicts of administrative and legal support of fire safety in the forests of Ukraine are outlined and amendments to the system of current domestic legislation are proposed.
