Skorobahatko A. Unity and differentiation of legal regulation of pension insurance in Ukraine.

The main methodological approaches to the study of the role of unity and differentiation in pension provision are defined in the work, the formation, development and current state of theoretical thought of research of these legal categories are covered. The essence of the legal categories of unity and differentiation is determined, their interaction in the legal regulation of pension provision is revealed. For the first time, a study of the motives and goals of differentiation in pension provision and the characteristics of these legal categories. Considerable attention is focused on the definition and characterization of the criteria for differentiation of pension provision. Particular attention is paid to the study of law-making legal facts: retirement age and length of service. The guidelines of the new pension system in Ukraine are outlined. The pension provision of certain categories of transport workers is analyzed in detail, the peculiarities of their legal regulation are revealed. The dissertation contains useful information for law enforcement and law - making practice in the part of research of formation of social and legal policy of the state in the field of pension provision. A thorough analysis of the formation of the pension system in Ukraine is completed and the stages of its formation are identified. It is argued that this period consists of 4 stages. The priority directions of development of pension provision in modern social and economic conditions are defined, tendencies of application of unity and differentiation in the pension legislation are revealed and concrete offers concerning its improvement are formulated. Based on the analysis of existing scientific ideas, study of pension legislation and the peculiarities of its application to certain categories of persons formulated their own understanding of the essence of the interaction of unity and differentiation in the regulation of pensions, the impact of these categories on the pension system is identified.
