VESELOVA L. Administrative-legal bases of cyber security in the context of hybrid war

Within the object and subject of the research a wide range of problematic issues is revealed, from the methodological bases of knowledge of "cybersecurity" phenomenon to the actual paradigm of administrative-legal support of cybersecurity in the hybrid war’s context. The nowadays understanding of the development of social relations in cyberspace, their dualistic content for Ukraine is substantiated. The historical aspects of the formation are revealed and the current state of regulatory-legal support in this area is analyzed. Emphasis is placed on significant legal conflicts and gaps in domestic legislation in the field of cybersecurity and especially in hybrid war. Emphasis is placed on the need to form a conceptual and terminological apparatus of administrative-legal support of cybersecurity. The legal-functional aspects of the national cybersecurity system formation are substantially revealed: key aspects of application mechanism of administrative-legal measures to ensure cybersecurity; the content administrative-legal protection, its forms and methods in the field of cybersecurity; essential characteristics of administrative responsibility in the field of cybersecurity; content and features of administrative-legal relations in the field of cyber security of Ukraine; administrative-legal status of the subjects of cyber security of Ukraine with the allocation of problematic issues; general tendency and features of interdepartmental and public-private cooperation in the cyber security system of Ukraine. The methodological significance of the mechanism’s formation of administrative-legal regulation in this area based on legal settlement of obligations of the national cybersecurity system to identify cybersecurity risks and implement a risk-oriented cybersecurity strategy is substantiated. The international experience of strategic character concerning formation of the security environment and stability of society in the context of hybridization of international relations is generalized and offers of perfection of administrative-legal maintenance of cybersecurity in Ukraine are formulated.
