Chornopyska V. Administrative and legal guarantees of the activities of religious organizations in Ukraine

The dissertation deals with the comprehensive study of administrative and legal guarantees of the activities of religious organizations in Ukraine. The scientific basis and methodology of the research of administrative and legal guarantees of activities of religious organizations in Ukraine are determined, the definition is formulated, features is defined. The structure of the administrative and legal status of religious organizations in Ukraine is analyzed. The system characteristics of administrative legal personality of religious organizations in Ukraine are presented. The characteristic and constituent elements of the system of administrative and legal guarantees of the activities of religious organizations in Ukraine are characterized. Normative-legal, organizational-legal and administrative-procedural guarantees of the activities of religious organizations in Ukraine are detailed. The subjects of the system of administrative and legal guarantees of religious organizations in Ukraine are identified. The directions of strengthening the administrative and legal guarantees of religious organizations is substantiated. The author's approach to introducing changes to the current legislation in order to improve modern administrative and legal guarantees of the activities of religious organizations in Ukraine is proposed. Amendments to the content of the Code of Ukraine on Administrative Offenses concerning the list of administrative offenses that violate the rights of religious organizations have been elaborated and proposed. It is proved that the modernization of administrative and legal guarantees of the activities of religious organizations in Ukraine should be carried out on the basis of the experience of foreign countries, including the United States, Great Britain, Australia, and Canada.
