Radyshevska O. Europeanization of Administrative Law of Ukraine: Theory and Practice

The dissertation is devoted to the complex research of topical theoretical and practical aspects of Europeanization of administrative law of Ukraine. The author has analyzed the doctrines of Europeanization, Europeanization of law, Europeanization of administrative law existing in European and Ukrainian sciences. The author's definitions of the last two concepts are formulated. The reasons, characteristics, types, mechanisms and tools of Europeanization of administrative law of Ukraine, its stages and legal consequences are determined. The directions of legal influence of Europeanization on administrative law of Ukraine as a branch of public law, legal science and academic discipline are clarified. Emphasis is placed on the pan-European trends in the development of fundamental provisions of modern administrative law of Ukraine (on the doctrine of the subject, method, system, principles, sources, administrative procedure, and axiology). It is established that the intensity, cyclicality, phasing, vector of legal influence, peculiarities of application of types and mechanisms of Europeanization of administrative law of Ukraine depend on a number of factors such as Ukraine`s membership in international organizations; priority of application of provisions of the European and international law; fulfillment by Ukraine of international obligations in the administrative and legal sphere; statements of European legal identity of the Ukrainian citizens; directions for the development of administrative law as a science and academic discipline in higher education institutions.
