Yakovliev A. The constitutional process in Ukraine: theoretical and practical aspects of implementation.

The research of theoretical and methodological bases of constitutional process in Ukraine is carried out in the paper, in particular the concept of constitutional process in modern science of constitutional law is established, it is considered as a factor of democratization of the state, the principles of social statehood in modern constitutional process and the principles of the rule of law in the context of ensuring the constitutional process are studied. With the help of retrospective constitutional and legal analysis, the constitutional process in Ukraine of the XX – early XXI centuries is studied, the constitutional acts of the national liberation struggle of 1917–1921 and the constitutional acts of the Soviet period are examined, the constitutional process of independent Ukraine is analyzed. The constitutional process through the prism of transformation of institutions of state power and local self-government is highlighted, in particular the analysis of development of parliamentarism, consideration of reforming of system of executive power, research of constitutional and legal aspects of development of institute of the head of state, characteristic of process of modernization of system of judicial and law enforcement bodies, analysis of the constitutional and legal development of the foundations of local self-government are conducted. The top problems of the constitutional process in modern Ukraine are studied, in particular the political and legal determinants of the constitutional process are revealed, the significance and role of constitutional jurisdiction in the constitutional process, peculiarities of their reforming are considered, the problems of constitutional legislation stability are studied.
