Kapitanenko N. Administrative and legal regulation in the field of intellectual property right implementation

The thesis researches the administrative and legal regulation in the field of intellectual property right implementation, the essence of which is the consistent, effective, regulatory and organizational use of administrative and legal means by public authorities to ensure order, implementation and protection of the rights of legal relations’ participants. The thesis also provides a historical and legal characteristic of administrative and legal regulation in the field of intellectual property right implementation with the definition and grounding of the periodization of this process in independent Ukraine. The thesis characterizes the normative and legal fundamentals of administrative and legal regulation in the field of intellectual property right implementation, which passes the stage of search of balance of private-legal and public-legal interests both in social practice and in legal regulation for harmonious development of society. The thesis specifies the system, as well as administrative and legal status of the subjects of relations in the field of intellectual property right implementation in terms of harmonization of the legislation of Ukraine and the European Union in this area. The thesis clarifies and develops the features of administrative and legal regulation of copyright, in the field of implementation of intellectual property right to trademark and trade secret, the content of which is to regulate public relations considering these objects of intellectual property right between public authorities and subjects of intellectual property right and other participants in legal relations through a set of legal remedies.
