Boldizhar S. Administrative and legal support of the fourth generation of rights in the field of health care

The thesis is devoted to complex research problems of theory, methodology and practice of administrative and legal support of the fourth generation of rights in the field of health care. The content of the category "human rights of the fourth generation" is described, the classification is carried out. Modern scientific research into the evolution of fourth-generation human rights in the health care system is in-depth. The content and components of the mechanism of administrative and legal regulation are analyzed, based on their organic and functional features. Particular attention is paid to the relationships between the components of the mechanism and the analysis of their combined action, as the relationships between the components ensure the unity of the mechanism itself. Features of legal provision of human rights of the fourth generation in separate spheres of medical activity are characterized. Among such areas, transplantation of anatomical materials is highlighted and problematic issues of legal regulation of this type of medical intervention are studied. The legal regulation of artificial insemination and the use of other assisted reproductive technologies in Ukraine are described.
