Krasnohor V. Organizational and legal principles of ensuring notarial secrecy

The purpose of the dissertation is to determine the essence and reveal the content of organizational and legal principles of notarial secrecy and formulate directions for their improvement on the basis of studying the norms of national legislation, international regulations, basic and applied research. The historical and legal aspect of the formation of notarial secrecy as a legal category is revealed. The concept, content and features of notarial secrecy as an object of administrative and legal regulation are defined. The current state of legal regulation of notarial secrecy in Ukraine is clarified and the place of administrative and legal norms is determined in it. The subjects of ensuring notarial secrecy and the powers they are endowed in this area are described. Analyzed and disclosed administrative and legal guarantees of notarial secrecy. The principles of administrative and legal regulation of notarial secrecy in Ukraine are determined. Forms, methods and means of ensuring notarial secrecy are described. The experience of administrative and legal support of notarial secrecy in foreign countries with Lithuanian and Anglo-Saxon types of notaries is compared. Based on the analysis of the experience of administrative and legal support of notarial secrecy in foreign countries, ways to improve the administrative legislation governing the provision of notarial secrecy are proposed.
