Ponomarenko V. Criminal-legal counteraction to group hooliganism in Ukraine

The dissertation is a comprehensive study of the peculiarities of criminal law counteraction to group hooliganism, committed in various forms of complicity. It was determined that complicity in hooliganism in the science of criminal law was not the subject of a separate scientific study at the level of the dissertation. Analysis of judicial practice, including 2-4 Art. 296 of the Criminal Code of Ukraine showed that courts are often limited to stating the fact of joint hooliganism. That is, law enforcers do not pay due attention to the criminal law assessment of the group nature of hooliganism. It is substantiated that the lack of differentiation of criminal liability for group hooliganism leads to leveling the provisions of the institution of complicity in the General Part of the Criminal Code of Ukraine, primarily in terms of distinguishing its forms, and taking into account the types of accomplices in an intentional crime under Art. 296 of the Criminal Code of Ukraine.
