Essay

The dissertation is devoted to a comprehensive study of theoretical and practical problems of legal regulation of work due to the employment contract, and the substantiation of the properties of the employment function as a necessary (essential) condition of the employment contract, disclosed through profession, specialty, qualification and position. The dissertation formulates a number of scientific provisions and conclusions proposed personally by the applicant. There are researched the general theoretical principles of determining the labor function of the employee in the context of the characteristics of the labor function as a legal concept, and there are disclosed the content and elements of the labor function in accordance with the labor legislation of Ukraine. There are clarified the properties of the labor function as a legal means of protection and defense of labor rights and interests of the parties of the employment contract. This has improved the approaches to understanding the labor function as a specific legal concept, which is the basis for disclosing the content of work under the employment contract, and reveals the essential properties, characteristics and features inherent in the performance of work under the employment contract.
