Essay

This dissertation research is aimed at covering the current system of real rights to land. The topic is relevant given the unique constitutional and environmental significance of land, which is both property and natural resource. The study also shows the incompleteness of land reform, despite Ukraine’s restoration of independence which took place more than 30 years ago. Previous research in the field of land law has focused primarily on individual property rights to land. At the same time, the comprehensive dissertation study of property rights to land rights as a system in the Ukrainian land law scholarship was not conducted. This work is one of the first scientific contributions in Ukraine that fills this gap. The dissertation analyses the system of real rights to land in three dimensions, in particular: research of the historical development in independent Ukraine; study of the contemporary system of real rights to land, with their current list; making proposals for improving the existing system, taking into account both historical development and foreign experience.
