Essay

The thesis proposes a new solution to the problem of the place and role of the freedom of the contract in economic law by substantiating theoretical provisions concerning the peculiarities of its content in economic turnover, drawing the limits of this principle and clarifying the grounds for limitation, in particular in the sphere of rendering banking services. The banking sector of the economy is not chosen by chance. The efficiency of the banking system is one of the main conditions for the development of the economy and its stability before the crisis. What is becoming the biggest actualist today – in the conditions of military intervention of the Russian Federation on the territory of Ukraine, which has become a powerful destabilizing factor for the economy of our country. The work also formulated proposals for improvement of domestic legislation in this sphere. The practical significance of the results obtained is that they can be used In the legislative activity – when changes and additions to the Economic Code of Ukraine and other legislative and subordinate normative­legal acts are made; in law enforcement and judicial practice – in the settlement of contractual disputes, the parties of which are economic entities and consumers of banking services; in research work. The dissertation is accompanied by the draft Law of Ukraine “On amendments to Commercial Code of Ukraine”. The legal result of the dissertation is used in the activity of the Ukrainian Parliament Commissioner for Human Rights (Annex B), as well as in the activity of the of the ordinary court in terms of protecting the rights of consumers of banking services.
