The dissertation is devoted to the analysis of existing scientific approaches, the legislation of Ukraine and the practice of its implementation with the aim of solving the scientific task of determining the theoretical foundations, methods, mechanisms and features of the administrative and legal provision of the child's right to safe living conditions.
The concept of administrative-legal provision of the child's right to safe living conditions is defined as an executive-administrative process of regulating social relations implemented by the state and based on the norms of administrative law, which involves the concentration of efforts of state authorities and civil society aimed at creating favorable conditions for life and development child, timely detection, prevention and neutralization of threats to his safety, as well as minimization and elimination of consequences in case of their implementation by applying a complex of administrative-legal, political-organizational, socio-economic, material-technical and other measures.
The expediency of recognizing child safety as a priority object of administrative and legal support, which is carried out by a special system of state authorities, local self-government and individual institutions of civil society, and aimed at the expense of tasks, principles, main directions and mechanisms to create socio-political, legal, organizational and managerial, innovative and technological; personnel; financial and economic conditions and guarantees of physical, intellectual, cultural development of children, provision and protection of their rights and legitimate interests.
The need for the formation of a fundamentally new paradigm of safe childhood is substantiated, which will involve taking measures to deter and counter threats to child safety, developing minimum standards for such safety, systematizing information about types of threats, sources of their occurrence and spread, creating an effective system of interaction between state authorities, local authorities self-governance and society, as well as the development of international cooperation in the field of childhood protection on the basis of partnership and mutual support, the formulation of theoretical and conceptual principles and provisions, strategic measures and programmatic guidelines for the public-legal provision of the rights, freedoms and legitimate interests of minors in the National Doctrine child safety in Ukraine. The structure and content of the latter is dictated by the main problems in the field of childhood, in particular: insufficient effectiveness of existing public legal mechanisms for ensuring and protecting the rights and interests of children, non-fulfillment of international standards in the field of children's rights; high risk of poverty, especially in large and single-parent families; prevalence of family dysfunction; the low effectiveness of preventive work with disadvantaged families and children, the prevalence of the practice of deprivation of parental rights and social orphanhood; duplication of powers between subjects of public administration regarding the volume and quality of available services for children and their families, etc.
The normative principles of ensuring a child's right to safe living conditions are characterized, which currently comprise a significant number of national normative legal acts, which determine: 1) general principles of ensuring the safety and well-being of a child; 2) legal status of the subjects of ensuring child safety; 3) organizational and legal mechanism for providing children with medical care; 4) the organizational and legal mechanism of interaction between the subjects of ensuring child safety; 5) legal principles for preventing and countering domestic violence against children; 6) strategic planning measures to protect the rights and interests of children and adolescents; 7) financial and economic principles for the implementation of measures to ensure the rights and legitimate interests of children; 8) separate areas of childhood protection and implementation of children's right to safe living conditions; 9) features of application of measures of administrative responsibility for violation of children's rights and legitimate interests.
