Zaykova L. Adaptation of the legislation of Ukraine on waste to the legislation of the countries of the European Union

The dissertation is a comprehensive study of the problems of adapting the legislation of Ukraine on waste to the legislation of the countries of the European Union. It has been established that the current regulatory legislation of Ukraine, despite the established EU standards for determining the content of waste, retains as a priority their use and management of the application of the criterion of origin of such substances, objects, their aggregates. It is emphasized that the establishment of a causal relationship between the criterion of the activity from which wastes originate and their material properties should influence the establishment of a regime for their management, disposal and recycling. The lack of unity of approaches to establishing the content of the category "waste" is emphasized, which is fixed both at the legislative level (in the Laws of Ukraine "On Waste", "On Waste Management", "On Alternative Fuels"), and at the level of regulation (in the State Classifier waste). The lack of unity of approaches to the definition of the category "waste" in scientific and practical publications is determined, where such approaches to understanding waste are highlighted, such as: a resource for further use; dangerous polluting factor; the result of various economic and production processes and human activities; as an unnecessary thing, ownerless property. It is substantiated that waste should be recognized as property, for the management of which their owner is endowed not only with a set of property rights, but also with established obligations, which consist in creating conditions for preventing their formation, optimizing the processes of separate collection and handling, and using them as a secondary raw material. The scientific novelty of the obtained results lies in the fact that the dissertation is defined as one of the first comprehensive monographic studies devoted to the study of the problems of adapting the legislation of Ukraine on waste to the legislation of EU countries in the field of waste management in Ukraine.
