The dissertation is aimed at solving theoretical and practical issues of organizing interaction between the investigator and operative units during the detection and investigation of premeditated murders.
To determine the issues of the research, a study of the scientific work in the fields of the theory of the criminal process, criminalistics and investigative activity was carried out on the subject of the state and degree of studying the issues of the organization of interaction between the investigator and operative units during the detection and investigation of criminal offenses and, in particular, premeditated murders. As a result, it was found that even if scientific works or their separate parts, for example, regarding the specifics of the investigation of certain types of criminal offenses – the same intentional murders, contained in their title an indication of the organization of interaction between the investigator and operational units as a subject of research, this, as a rule, did not determine that direct attention would be paid to the issues of organizing such interaction. In the theory, there was a blurring of the concept of the organization of interaction in the general relative to it, the concept of interaction between the investigator and operative units during the detection and investigation of a criminal offense. Based on the hypothesis that the organization of interaction is a key component of ensuring the joint solution of tasks by investigators and operative units regarding the quick, complete and impartial disclosure and investigation of a criminal offense, bringing guilty persons to justice and solving other tasks of criminal proceedings, it is determined that without clear ideas about the content, the essence and structure of the organization of the interaction of the investigator and operative units cannot ensure on a systematic basis the high-quality implementation of their joint activities in the detection and investigation of crimes. It was established that premeditated murders are crimes, the commission of which always causes a significant public outcry, and based on the results of the investigation, society evaluates the quality of the work of law enforcement agencies. That is why the issue of organizing interaction between the investigator and operative units during the detection and investigation of these crimes is defined as relevant for the theory and practice of investigating criminal offenses.
Also, based on a wide range of crimes that involve criminal liability for intentionally causing the death of another person and are subject to investigation by various bodies of pre-trial investigation, there is a well-founded need for regulation at the level of the relevant interagency (Ministry of Internal Affairs, Security Service of Ukraine, State Bureau of Investigation, Bureau of Economic Security, National Anti-Corruption Bureau of Ukraine) of the act on the creation and organization of the work of interdepartmental investigative and operational teams in criminal proceedings, and not only in relation to the intentional causing of death to another person, which are transferred from one body of pre-trial investigation to another in order to ensure the stability and intensity of work in such criminal proceedings.
