In the dissertation, a comprehensive scientific study of the administrative and legal regulation of the use of information technologies in the sphere of implementation and protection of social rights of citizens is carried out.
The work defines the circle of information resources in the social sphere, summarizes the list of social information that circulates in them, defines the main normative legal acts that regulate their functioning, identifies the shortcomings of domestic legislation in this sphere and the prospects for its improvement in order to bring closer the implementation of the goals of the Digital Strategy transformation of the social sphere.
It was found that the information that ensures the realization of the social rights of citizens and circulates in the information resources of the social sphere includes: information that gives the opportunity to apply for state social assistance for children; about the social status of a citizen; contained in the mandatory state social insurance certificate, in the pension certificate, in the electronic pension file; about a person's disability; about wages, paid insurance contributions, pension amount; on the appointment of housing subsidies, social assistance to low-income families; about orphans, children deprived of parental care, children in difficult life circumstances, etc.
The list of information resources in the social sphere is defined. Such shortcomings of the legal regulation of the functioning of information resources in the social sphere as the lack of a systematic approach were revealed; non-regulation of the use by social protection institutions in the social sphere of such resources as an electronic cabinet, a web portal, a website, a portal of electronic services; lack of feedback mechanisms with citizens regarding the quality of these resources; insufficient level of information interaction of public authorities in the social sphere; non-compliance with international standards of personal data protection and transparency of public authorities.
An analysis of existing definitions of the concept of informational legal relations was carried out, a proper definition of "informational legal relations in the sphere of implementation and protection of social rights of citizens" was formulated, and a general description of the content of these relations was carried out. Emphasis is placed on defining the range of subjects of informational legal relations in the sphere of implementation and protection of social rights of citizens, which include public authorities that ensure the implementation and protection of social rights of citizens; courts; banks; social service providers; organizations that pay and deliver social benefits at the place of actual residence of recipients and natural persons; implementation and protection of social rights which are carried out by social institutions. The object of information relations in the field of realization and protection of social rights of citizens is specified: information necessary for the appointment, accrual, adjustment of any social payments, provision of social benefits, services, implementation of measures provided for citizens by legislation, and provided by social protection institutions.
