Kiiashko Y. Administrative and legal means against threats to the economic security system of Ukraine that may arise as a result of transactions with digital assets

The study is the first to implement an attempt to form a favorable theoretical, methodological, methodological and legal basis for the development of a comprehensive administrative and legal framework for countering threats to the economic security system of Ukraine that may arise as a result of transactions with digital assets. The corresponding results were obtained taking into account the considerations of leading foreign and domestic scientists, norms of international law, national and foreign legislation, documents of a recommendatory nature, practices of their application, projects, as well as various types of analytical materials. The category of “economic security system of Ukraine” is studied through the prism of the object of public legal support. A theoretical and legal characteristic of digital assets is carried out, formulating the concept, outlining the properties and features, and evaluating approaches to understanding its forms. The concept, properties, features are defined and points of view on the classification of threats to the economic security system of Ukraine are highlighted, as well as clarifying the place and role of the digital component among them. The topic of the exceptional importance of international and foreign standards and legal mechanisms for countering threats that may arise as a result of transactions with digital assets is revealed and their impact on the results of national lawmaking is assessed. The administrative and legal principles for countering threats to the economic security system of Ukraine that arise when conducting transactions with digital assets are outlined and classified. The administrative and legal status of entities of the economic security system of Ukraine with special competence that counteract threats that arise when conducting transactions with digital assets is characterized through the prism of the levels and directions of their functional influence. The essence of the administrative and legal mechanism for interaction of entities of the economic security system of Ukraine with special competence that may arise as a result of transactions with digital assets is revealed. The issue of state control and supervision during transactions with digital assets is studied. A review and comparative analysis of international and leading foreign models of countering threats that may arise as a result of transactions with digital assets have been conducted. Priority vectors for the development of administrative and legal regulation to counter threats to the economic security system of Ukraine that may arise during transactions with digital assets have been outlined. The feasibility of ways to implement directions for the formation of comprehensive administrative and legal support to counter threats to the economic security system of Ukraine that may arise as a result of transactions with digital assets, taking into account the experience of foreign countries, has been proposed and substantiated.
