Anpilogova B. Social risk as the basis of the legal mechanism of social protection

This dissertation clarifies the content of social risk as the basis of the legal mechanism of social protection and proposes recommendations for improving Ukrainian legislation in the field of social security, with due consideration of social risk. It establishes that social risk is a multifactorial and dynamic socio-legal phenomenon arising from the complex interplay of real-life circumstances. Deeply embedded in societal institutions and inseparable from their daily functioning, social risk is characterised by uncertainty in its onset and a threat to fundamental socio-legal values, thereby necessitating regulatory, organisational, and institutional measures to prevent, minimise, or compensate for potential adverse consequences. The characteristics of social risk demonstrate its role as an institutional catalyst for the development and refinement of socio-legal forms, methods, and means of social protection, thus constituting the foundation of the legal mechanism of social protection.
