Mel'nyk O. Problems of a right protection of marks for the goods and services in Ukraine

Об'єкт дослідження - Path of improvement of the mechanism of regulation of the relations concerning a right protection of signs for the goods and services in Ukraine. Мета дослідження - There is scientific-theoretical analysis of the current legislation of Ukraine about the trade-marks, and also appropriate legislation of separate foreign countries and practice of its application, proper scientific valuation, and on this basis - development of appropriate conclusions. Методи дослідження та апаратура - Methods of scientific knowledge: the systems analysis of the researched phenomena and events; the comparative analysis of the rules of law, concepts and bases; the formal-logical, historical analysis of legal categories; forecasting. Теоретичні результати і новизна - The stated theoretical rules can serve as source scientific base for further learning in sphere of a right protection of the trade-marks. Практичні результати і новизна - The offers, stated in it can be: а) Are used for improvement of the cu rrent legislation of Ukraine about the trade-marks and, first of all, Law of Ukraine " About protection of the rights on signs for the goods and services"; b) are taken into account for want of to final completion of the project of the Civil code of Ukraine; c) useful for want of to preparation of the textbooks and methodical allowances of study of civil law, and also are used directly in educational process; d) are taken into account for want of improvement of practice of application of the current legislation of Ukraine about the trade-marks. Предмет і ступінь впровадження - Theoretical development and the practical recommendations were introduced into practice of legal proceedings and educational process of National academy of internal affairs of Ukraine. Ефективність впровадження - The methodical recommendations have received positive valuation. Сфера використання - Educational, scientific, legislative.
