Kuz'min R. Application of the Economic Administrative Sanctions, as a Means de-shadowing of Economy

Object of research: the relations, that arise at performance of shadow economic activity, and also at realization of the state program of prevention and legalization of shadow managing. Purpose of research: a substantiation of theoretical and practical aspects of application of the economy-administrative sanctions, as way de-shadowing of economy, development on this basis of the recommendations on perfection of the current legislation, and also definition of the basic ways of elimination of the contradictions in the working economic legislation, that the realizations of the state program of struggle with shadowing of economic activity interfere. Methods of research: the dialectic method of knowledge, scientific methods theoretical, is formal - logic, system, structurally - functional, law-comparative analysis. Theoretical and practical results: The practical recommendations and offers on perfection of the economic legislation are developed, that is applied by law-enforcement and supervising bodies in struggle with shadow managing. The materials of the dissertation were used during organization of activity of bodies of State tax Administration of Donetsk area, state bodies of the executive authority, Donetsk territorial branch of Antiexclusive committee of Ukraine. Innovation: complex research devoted to problems of application of economy-legal methods de-shadowing of economy in Ukraine for the first time is executed the essence and sense of concepts " shadow economy ", as categories by more volumetric, and " of shadow managing ", as parts of shadow economy is formulated; the kinds of shadow managing are determined; is determined and the application of the economy-administrative sanctions as a method de-shadowing of economy is proved. The materials of the dissertation enable of complex representation about the basic principles and methods of the decision of a problem of prevention and suppression of shadow managing, opportunity of legalization of its some forms. Area of application: law-making bodies in Uk raine, ministry and department, bodies of Antiexclusive committee of Ukraine, legal and economic educational institutions.
