Protas I. Problems of judicial defence of the rights and interests of citizens due to the damage caused by illegal action of preliminary investigation bodies, prosecution and court.

The thesis is dedicated to the research of the juridical nature of Civil Law institute in relation to the damage compensation caused by illegal action of preliminary investigation, prosecution and court. In the thesis the research is made of the right of citizens for judicial defence of their rights and interests in relation to the damage compensation caused by illegal action of agencies of preliminary investigation, prosecution and court. The forms of defence, the field nature of legal relations under study, the main problems and perspectives of the development of this institute are analysed. The thesis sets out the action of the procedural mechanism of renovation of violated rights of citizens in these delicts along with the analysis of the peculiarities of the given category of cases. There is formulation of practical recommendations as to the improvement of the institute of judicial damage compensation caused by agencies of preliminary investigation, prosecution and court.
